  Long story short, the agent have only inspected our place 1 week after we moved out and has never provided a formal condition report. They have emailed us mentioning that the windows, mirrors and tiled floors needed to be cleaned. So, we assumed everything else is “reasonably clean” (the legal requirement for returning a place) and need no ratification.

  The original white tiled floors looked dark and dirty though it is actually in quite poor quality so we know that it can never be whitened completely. Despite that, we have agreed a partial cleaning and they have quoted a cost of $40 so we said fine. However, they have ended up doing a full cleaning of the place and claimed us $200.

  Worse still, they have requested the transfer of the whole amount of our bond from Fair Trading to them without our knowledge and only returned the net amount to us, leaving us extremely difficult to chase the disagreed amount (we have to go through the Tribunal now if we have to do so). As we have the absolute legal title of our bond apart from any agreed claim amount, what they have done was illegal and has contravened the residential tenancies act 2010 Section 165 and subject to a maximum fine of $2000.
